What's NewCity of Spring Hill’s Response to Overland Park’s Annexation Petition Adverse Effect of Proposed Overland Park, Kansas Annexation Upon the City of Spring Hill, Kansas
1. The Growth Pattern of Spring Hill will be dramatically and adversely affected if the Spring Hill Urban Fringe Area (SHUFA) is annexed by Overland Park. 2. Spring Hill Utility Service Costs will be greater as a result of Overland Park’s annexation of the SHUFA. 3. Spring Hill will suffer economically as a result of Overland Park’s annexation of key transportation links, including 191st Street and 199th Street corridors within the SHUFA. 4. Annexation of the SHUFA is Premature. 5. Spring Hill has made a significant financial commitment to the north and northeast areas and has the ability to make future improvements and provide municipal services within the SHUFA. 6. Existing Governmental Services and Community Identity with Spring Hill.
· July 13, 2007: John Nachbar, Overland Park City Manager, announced that his staff would present plans to the Overland Park City Council for filing an annexation petition with the Board of County Commissioners of Johnson County that provided for the annexation of approximately 15 square miles of land, which would extend the city’s boundaries along Lackman Road on the west and U.S. Highway 69 on the east, generally south to 203rd street.
· July 26, 2007: The Spring Hill City Council authorized the submission of a proposed annexation agreement with Overland Park, Kansas. · July 27, 2007: A proposed annexation agreement was submitted to the City of Overland Park, Kansas. Spring Hill received no formal response to the proposed annexation agreement. · August 20, 2007: Overland Park’s staff presented a proposal to annex approximately 15 square miles of land to the Governing Body of Overland Park. · August 23, 2007: The City of Overland Park presented to the Board of Johnson County Commissioners an annexation petition pursuant to K.S.A. 12-521. · September 10, 2007: The Overland Park City Council approved Resolution No. 3619, including its six ordinances, which will go into effect only if the proposed annexation plan is approved. · September 24, 2007: The Overland Park Planning Commission found that the city’s proposed annexation is compatible with the city’s Master Plan as it applies extraterritorially to a small portion of the area proposed to be annexed, in the vicinity of 175th and Pflumm. · September 25, 2007: The Johnson County Planning Commission found that the city’s proposed annexation is compatible with the county’s Rural Comprehensive Plan. · September 27, 2007: The City of Overland Park hosted an informational meeting on the proposed annexation plan where residents and property owners in the identified area could ask questions of various city department officials. No formal presentations were made. · October 8, 2007: Spring Hill’s Mayor, Mark Squire, submitted a letter to the Board of Johnson County Commissioners stating the City’s objections to Overland Park’s Annexation Petition. · October 30, 2007: The Board of Johnson County Commissioners conducted a public hearing on Overland Park’s Annexation Petition. At the hearing, Mayor Squire presented Spring Hill’s opposition to the annexation of the area in Spring Hill’s Three-Mile Urban Fringe Areas as defined by K.S.A. 19-270. · November 10, 2007: Pursuant to the request of Overland Park, Mayor Squire and Mayor Carl Gerlach of Overland Park, along with their respective city representatives, met and discussed Spring Hill’s proposed annexation agreement. The two cities were unable to reach an agreement regarding the boundary line at that time. · November 15, 2007: The Board of Johnson County Commissioners extended the public hearing process and the time for the submission of information for the record related to the annexation petition submitted by Overland Park until February 15, 2008, 5:00P.M. (Resolution No. 086-07) · November 27, 2007: In an effort to offer a compromise, Spring Hill again submitted a compromise proposal to Overland Park. Spring Hill has not received a response from the City of Overland Park to this proposal. · February 15, 2008 5:00P.M.: Deadline for comments and information on Overland Park annexation petition will be accepted through Friday, February 15, 2008, 5:00P.M.
